Personal Injury

If you are injured as the result of a motor vehicle accident, defective product, etc., it is important that you know your legal rights. Soon after an accident, you will probably recieve a call from a representative of an insurance company who will likely request that you provide a recorded statement. Before you discuss your claim with an insurance company representative, you should consult with an experienced personal injury attorney.

When should you contact an attorney?

  • If you are injured in an accident
  • If you wish to file a tort action against the at-fault party
  • If you selected limited tort and have questions about exceptions
  • If you need help filing a claim with your insurance company for wage loss and medical benefits
  • To recover money for damage to your vehicle if insurance coverage is not available

What is a standard attorney fee in a personal injury case?

Attorneys who handle personal injury claims charge a contingent fee. A contingent fee provides for a percentage of the gross recovery which is typically one-third. In addition, an attorney will request reimbursement of money advanced to cover costs associated with pursuing a claim.

How much time do I have to pursue a claim?

Generally speaking, a lawsuit must be filed within two years of the date you were involved in the accident that caused your injuries. If you are a minor at the time of the accident, then you must file a lawsuit within two years of your eighteenth birthday.

There are exceptions to the two year statute of limitations, so it is important that you seek legal advice from an experienced personal injury attorney

If I file a personal injury claim, will I have to go to court?

Personal injury claims rarely result in a trial. A personal injury claim is typically resolved through negotiation between a representative of an insurance company and the attorney representing the injured party. A trial involves a great deal of time, money and stress for both sides, so every effort is made to settle a claim outside of court.

It is important that you have an attorney in your corner that has the experience, legal knowledge, and negotiating skills to obtain a fair and just settlement of your claim
